Terms & Conditions

The following terms and conditions apply to all transactions at gubbins.simonherman.co.uk. Placing an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference.

The Goods
We endeavor to give as much technical information as is reasonable about the products we sell. All images, descriptive matter, specifications and advertising on our site are for the sole purpose of giving an approximate description of the goods. We always try to make sure that the information given on our site is as up to date as possible but we cannot guarantee that this will always be the case. Full detailed specifications are possibly available on other websites, and if you require more information on an item it is always advisable for you to contact us BEFORE purchase.

Payment and Price
The total price payable for the goods and delivery will be as shown at the time when you place your order. We are entitled to make adjustments to the price if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. Errors like these are very unusual, and we will always inform you of the correct price and give you the opportunity to cancel the order.

Payment Methods
We accept PayPal and Apple Pay. All major credit and debit cards including Visa, MasterCard and Switch can be used once you add your item to basket and proceed to checkout.  Incorrect information will cause a delay in processing your order. Your order will only be processed once authorisation of your credit card has been properly received.

Availability of Goods
All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for them, and we will refund any money already paid. However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods.

Delivery Charges
All prices on our website are exclusive of delivery charges which will be added to the price of the products when added to the shopping basket. More information on packaging and overseas postage can be found on our Shipping and Security page.

Delivery Times
We send our items every day from Monday to Friday. In general, parcels go out within one day of receiving cleared payment. Any orders which arrive after Noon on Friday or over a weekend will go out on the following Monday. Although we hope you will not feel it necessary, you always have the right to cancel if you cannot wait for delivery.

Risk
Once we have delivered the goods to your door you are responsible for them. We will only deliver goods to the address on the order and parcels usually require a signature. It is very unusual for our parcels to be damaged in transit, or the incorrect good supplied, but if such situations occur, we may refund and will require a photo of damage caused in the mail system, so we claim for the damage through postal insurance.

Product Guarantees
We guarantee all games, handhelds and consoles to be fully working on arrival (unless listed as non-functioning). We bench test all the hardware we sell, so generally problems with consoles we sell are very rare. This guarantee specifically excludes faults caused by accident, neglect, and misuse. In addition routine maintenance is not covered. This does not affect any statutory rights that you may have.

Returned Goods
If you are not totally satisfied with your purchase for any reason, you have the right to cancel and return your order within 7 working days from date of delivery. For a full refund less any applicable delivery charges, the item must be returned to us in the exact state as it left gubbins.simonherman.co.uk. It’s condition must match exactly to the featured photos and files we have on system and published on our website product page. It is your responsibility to return any such items in a pristine saleable condition in their original box and packaging. You will be wholly responsible for the return of the goods and any associated costs of return.
Refunds will not be given to any goods received back incomplete, damaged or in any way differing to the item we posted to you. These items will be returned to you once the cost of return carriage has been received by you. In such rare circumstances both parties will communicate quickly and truthfully via email until the situation is resolved according to the terms mentioned here.
Prior to returning any products, please contact us within 7 days from the date of delivery. If you do not return goods within 7 days after you have informed us that you wish to return your order, your right to cancel will be withdrawn.

General
The terms and conditions shown above do not affect your statutory rights. We will treat each order for goods as an offer by you to purchase the goods subject to the terms and conditions as detailed above.

The returns address will be disclosed upon completion of transaction and emailed to you using your email provided during purchase.
